|This Policy applies in addition to the general terms and conditions and other documents included in the Contractual Documentation. In the event of any discrepancy between the general terms and conditions and these terms and conditions, the latter shall prevail.
|In case of disagreement with this Policy, the User is invited not to use the Site and not to communicate his personal data.
2. DATA COLLECTED
|Information freely provided by users. The User may be required to provide personal data concerning him/her to Oritage. The data required to send an Order include email address, postal address, first name, last name and/or company name. This data is mandatory and its absence may make it impossible to send the Order. Beyond the necessary data, optional data may be provided voluntarily by the User. The data necessary for use (mandatory) are mentioned in the forms by the addition of an asterisk or the impossibility of validating the form without filling in the dedicated field. In addition to the data provided on the Site, the Customer may be required to transmit his personal data as part of a Sales Contract. These data are treated in the same way as the data transmitted through the Site (but are not always digitized).
|Information concerning minors. No data concerning Users under the age of 18 is collected. Any data that may be collected involuntarily is destroyed as soon as possible.
3. USE OF COLLECTED DATA
|Automatically collected data. The data collected automatically allows Oritage to analyze the behavior of Users on the Site, traffic and preferences, in particular in order to optimize and improve the quality of its services.
|Data provided by Users or third parties. Oritage processes and uses the data necessary to fulfill its contractual obligations and to verify compliance with the terms and conditions of use. The processing of this data also makes it possible to provide personalized content to better meet the User's expectations.
4. COMMUNICATION AND DATA TRANSMISSION
|The User's personal data will not be passed on to third parties with the intention of using it for direct marketing purposes, unless the User has given his or her consent to the contrary.
|The User's personal data may be transmitted or disclosed to third parties in the following cases: (i) for the purpose of executing the contract between the Client and Oritage. The data collected in connection with an Order or during the execution of a Sales Contract may also be used for the purpose of promoting similar or identical items that may be of interest to the User; (ii) in connection with the provision of services on behalf of Oritage; (iii) where the User has given his consent; (iv) during joint promotions or programs with partners; (v) when required by law or when communication is reasonably necessary in order to execute a court decision or to respond to a legal claim; (vi) in the event of a merger, acquisition of the company or shares in the company by another company.
|Oritage reserves the right to anonymize certain data for the purpose of passing it on to third parties for research, statistical or marketing purposes.
5. USER RIGHTS
|Right of access. The User may at any time request access to his/her personal data stored by Oritage.
|Right of rectification. The User whose data is inaccurate or incomplete has the right to have it corrected.
|Right of withdrawal and/or opposition. The User may at any time object to the collection or processing of certain data concerning him/her (opting out). This opposition may result in the termination of use of the Site.
|Right of deletion. The User has the right to request the deletion of personal data concerning him/her when their use is no longer necessary or when the User no longer agrees with the processing of his/her data. Such data will be deleted as soon as possible, unless otherwise provided by law.
|Exercise of rights. To exercise the above rights, the User may make a request at any time to the following address: email@example.com.
|Oritage takes the protection of its Users' data very seriously and undertakes to treat their personal data confidentially and with the utmost care. In particular, Oritage takes appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of the data collected in accordance with Art. 7 of the Federal Data Protection Act (DPA) and Art. 8 to 9 of the Ordinance on the Federal Data Protection Act (FDPO). However, Oritage cannot guarantee full and complete protection of data against unauthorized processing due to the risks associated with the use of the Internet and electronic means of communication.
7. DATA RETENTION
|The data collected by Oritage is kept for as long as the purpose for which it was collected requires, subject to legal provisions providing for longer data retention periods. After this period, personal data is deleted.
8. INTELLECTUAL PROPERTY
